Kaupapa:- Review of the Deed of Trust

The Trust Board will be hosting two livestream Webinars to inform its members on the review status of its Deed of Trust and what could be changing in, or added to, the Deed and what relative legislature updates are in place since the Deed came into being 19 years ago. Members are encouraged to register in order to attend.

It is nineteen years since the Deed was established (22nd March 2006).  There have been changes to the Māori Fisheries Act 2004 •Māori Fisheries Amendment Act 2024 •Charities Act 2005, charitable law •Trusts Act 2019 •Charitable Trusts Act 1957 all of which will impact on the pending new Deed of Trust and in turn the Constitution of the Trust’s subsidiary Asset Holding Company – Ātiawa Nui Tonu Fisheries Limited.    

Hence a review is overdue, and much needed :-  

  1. to ensure the entity is still fit for purpose;       
  2. to ensure that the Deed is complaint with all legislative amendments that have occurred since it was established;  
  3. to enable amendments to the Deed that reflect current best practices;       
  4. to “Future proof” the Deed so it is flexible in the future; and       
  5. that the Deed must also reflect and be for the ‘collective benefit’ of the members.

Due to age of the current deed and number of amendments necessary, it has been put forward that a re-stated Deed is the most appropriate approach for consideration.

The Board acknowledges the importance of its registered members taking part in this most vital journey, and for the members to be as fully informed as possible on the process, and the components of the Deed before voting takes place.   

With this in mind there will be two livestream Webinar sessions which members are encouraged to join.   Presenters will consist of members of the Board and representatives from the Legal team assisting the Board.
